In response the the Department of Transportation (DOT) has amended its regulations (codified at 49 CFR Part 40) for conducting workplace drug and alcohol testing for the federally regulated transportation industry. The new regulations, which take effect August 25, 2008, require that all transportation workers who were previously tested (i.e., who have tested positive for a prohibited drug in the past) or who are returning to work acquire their urine specimens observed by example collectors

How’s that for an HR pickle?
I’m all for safe transit but I think that this is carrying things a bit too far and I wonder if there is a less
evasive way to screen for drug abuse? I have to believe that a royal lineage or hair sample would accomplish the same result with a lot less humiliation. I call to mind back in college, when physic testing was relatively commencing, we had to do an in class exercise where we had to empty a cup of water into any one the "yes we would carry a drug test to get a job" or "no, we would not take a physic test to get a job". At that time, the "yes" category won, hand’s down. And, I suspect that it would win today admitting that we did the same exercise.
I’m not advocating the removal of remedy testing for transit workers nor am I saying we shouldn’t go on foot to extra mile to make indisputable that the sample we are collecting is verily the worker’s pattern. What I am dictum is that I think this policy is starting to generate a bit invasive. Already, we as Americans are giving up so numerous company of our civil liberties in the name of "homeland security". Are we also going to give away our right to pee in private?
Let’s change the test to one that doesn’face to face require a urine example. Just a quick blood draw instead. And, while we’re at it, we can test for cholesterol level and diabetes. They can get a three-for-one.

Some transportation workers in Boston and across the nation may soon have an audience at what time they give urine samples beneficial to workplace drug tests, according to revised federal regulations.
The new US Department of Transportation Guidelines, which have the intended effect effect in November, will require “directly observed collection” of urine from employees who previously tested positive for drugs or from those whose prior urine samples appear to bring forth been tampered with.
“The looker-on must personally and directly watch the urine go from the employee’s body into the collection container,” the new guidelines say.
Observers will too demand that those employees raise their shirt and drop their pants to ensure that the employee is not using a device to sabotage the experiment, the new guidelines say.

“Unfortunately, there is a flourishing industry designed to help people facilitate continuing remedy use,” said Brian Turmail, a spokesman for the US Department of Transportation.
